Terms and Conditions for Let’s Eat With Kibwe
Effective Date: 01/01/2023
By booking or using the services of Let’s Eat With Kibwe (“we”, “us”, “our”), you agree to the following Terms & Conditions.
1. Services Provided
Let’s Eat With Kibwe offers:
• Private chef services and intimate dinners
• Catering for events (buffet, plated, family-style, etc.)
• Cooking classes and culinary experiences
• Any other culinary services described in a signed agreement or quote
2. Booking & Payment
• A booking is confirmed only after payment is processed and you receive a confirmation.
• A non-refundable deposit of 50 % of total is required at the time of booking to secure the date.
• The remaining balance is due 5 days before the event (or on a date agreed upon).
• If the final payment is not received by that deadline, we reserve the right to cancel services and retain the deposit.
3. Final Headcount, Service Style & Guest Details
• You must confirm the final guest count and service style (buffet, plated, family-style, etc.) no later than 10 days prior to the event.
• If dinnerware, place settings, or rentals required for plated (or served) service are not supplied or confirmed by that deadline, service will automatically default to buffet style.
• On the day of the event, any changes (e.g., switching from plated to buffet, allowing guests to self-serve, eliminating plates) must be approved — in writing or verbally — by you or an authorized representative (e.g., parent, planner, coordinator). Once service begins under those conditions, the event is considered fulfilled.
4. On-Site Authorization & Service Changes
• Decisions made on-site by the Client or authorized representative (including switching service style, allowing self-serve, or skipping dinnerware) are final and binding.
• Once the buffet is opened or service begins, the event is considered delivered under the agreed/modified service style.
5. Cancellation by Client & Refunds
• Cancellations made at least 1 month (30 days) before the event will result in a full refund of the deposit paid (less any non-refundable portion, if specified).
• Cancellations made within 30 days of the event will result in forfeiture of all payments (deposit and any further payments).
• No refunds will be issued for cancellations made less than 30 days before the event.
• If guest count is reduced after the final confirmation — or if fewer guests attend than confirmed — no refunds or credits will be given for the unused seats or meals.
6. Post-Event Claims, Refunds & Adjustments (3–7 Day Claim Window)
Because catering is perishable and general service is largely completed at the event, any claim for refund, credit, or adjustment must follow these guidelines:
• All claims must be submitted in writing (email is acceptable) within 3–7 days after the event date.
• Any request submitted after that 7-day window will not be accepted or considered.
• A valid claim must include: the date of the event, invoice number or contract reference, a clear description of the issue, and (when applicable) supporting evidence (e.g., photos).
• Refunds or credits are issued only at our discretion, on a case-by-case basis.
7. Leftovers, Portions & Consumption Variability
• Food quantities are based on the confirmed headcount and industry-standard portions.
• Leftovers are never guaranteed — they depend on guest consumption, timing, and any approved on-site changes.
• We do not issue refunds or credits based on portions eaten, leftover amounts, or personal expectations beyond standard portioning.
8. Liability & Client Responsibility
• The Client is responsible for ensuring that the venue and/or rental provider meets all necessary requirements (kitchen access, tableware, table settings, service logistics).
• We are not liable for any damages or issues arising from the venue or third-party vendors that were not disclosed to us in advance.
• Our liability for any claim (refund or otherwise) is limited to the total amount paid for the event.
9. Communication & Changes
• Any changes to guest count, service style, dietary restrictions, or other event details must be communicated by you (or your authorized representative) no later than 10 days before the event.
• On-site changes must be approved by you or your authorized representative before service begins.
10. Intellectual Property & Website Use
• All content on our website (text, images, logos, etc.) is our property and may not be used without prior written permission.
11. Limitation of Liability & Indemnification
• While we strive to deliver high-quality services, we are not liable for indirect damages, losses, or injuries related to use of our services or third-party venues.
• You agree to indemnify and hold harmless Let’s Eat With Kibwe, its agents, and affiliates from any claims, liabilities, or expenses arising from your event or use of our services.
12. Governing Law
These Terms are governed by the laws of Tennessee. Any dispute shall be resolved in the appropriate courts of Davidson County, TN.
